You can set your browser to refuse some or all cookies or to alert you when cookies are being sent; however, some parts of the Service may not function properly without them. For information about opting out of advertising cookies and browser-based opt-out signals, see “Your Privacy Rights” below.

Legal Bases for Processing (EEA and UK)

If you are located in the European Economic Area (EEA) or the United Kingdom, our legal bases for processing your personal information depend on the information concerned and the context in which we collect it. We process personal information where:

•     It is necessary to perform a contract with you (for example, to fulfill an order)

•     You have given consent (for example, for certain marketing)

•     It is in our legitimate interests and not overridden by your rights (for example, to improve and secure the Service)

•     It is necessary to process payments

•     It is necessary to comply with a legal obligation

How We Share Information

We do not sell your personal information for money. We may share personal information in the following circumstances:

•     Service Providers — with vendors that perform services on our behalf, such as hosting, order fulfillment, shipping, payment processing, analytics, advertising, email and text-message marketing, and customer support. These providers may access personal information only to perform tasks on our behalf and are obligated to protect it.

•     Advertising and Analytics Partners — as described in “Analytics and Advertising” below.

•     Business Transfers — if we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.

•     Legal and Safety — to comply with law or valid legal requests; to protect and defend the rights, property, or safety of RSC, our users, or the public; and to prevent or investigate possible wrongdoing.

Exclusion of text message data: The data-sharing practices described above exclude text messaging originator opt-in data and consent. We do not share your text message opt-in data or consent with any third parties for their own marketing or any other purpose. See “Email and Text Message (SMS) Marketing” below.

Note on “sale” and “sharing”: Some US state privacy laws define “sale” or “sharing” broadly to include the use of cookies for targeted advertising. See “US State Privacy Rights” for how to opt out.

Analytics and Advertising

We work with third-party providers to measure use of the Service and to deliver advertising. These providers may use cookies and similar technologies and may collect information about your activity over time and across websites.

Payments

Purchases made through the Service are processed through Shopify (Shopify Payments). If you choose a wallet or installment option at checkout (such as Shop Pay, PayPal, or similar), that option is provided by the applicable third party under its own terms and privacy policy. We do not store or collect your full payment card details; that information is provided directly to our payment processor. Our payment processing complies with the standards set by PCI-DSS, managed by the PCI Security Standards Council. You can review Shopify’s Privacy Policy at shopify.com/legal/privacy.

Data Retention

We retain personal information only for as long as necessary for the purposes described in this Privacy Policy, including to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements and policies. We retain Usage Data for internal analysis, generally for a shorter period, except where it is used to strengthen security or improve functionality, or where we are legally required to retain it longer.

International Data Transfers

We are based in the United States, and the information we process is maintained and processed in the United States and other countries that may have data protection laws different from those in your jurisdiction. Where we transfer personal information of EEA or UK residents outside those areas, we take steps to ensure appropriate safeguards are in place, such as standard contractual clauses. By using the Service or providing information to us, you understand that your information will be transferred to and processed in the United States.

Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect your personal information. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

If you are a resident of the EEA or the UK, you have the right to:

•     Access, update, or delete the personal information we hold about you

•     Correct inaccurate or incomplete information (rectification)

•     Object to or restrict our processing of your information

•     Data portability — receive your information in a structured, commonly used, machine-readable format

•     Withdraw consent where we rely on consent

You may exercise these rights by contacting us using the details below. You also have the right to lodge a complaint with your local Data Protection Authority (in the UK, the Information Commissioner’s Office).

If you are a California resident, you have the right to:

•     Know the categories and specific pieces of personal information we collect, use, and disclose

•     Request deletion of your personal information

•     Correct inaccurate personal information

•     Opt out of the “sale” or “sharing” of your personal information, including for cross-context behavioral advertising

•     Limit the use of sensitive personal information

•     Not be discriminated against for exercising your rights

We disclose these categories to service providers and to the advertising and analytics partners described above. We do not sell personal information for money, but our use of advertising cookies may constitute “sharing” or a “sale” under California law. You can opt out by (1) using the advertising opt-outs described above, and (2) enabling a Global Privacy Control (GPC) signal in a supported browser or extension, which we honor as a valid opt-out request for the browser through which it is sent. You may also submit a request using the contact details below. You may use an authorized agent to submit requests; we may require verification of your identity and the agent’s authority.

United States — Other States

Residents of states with comprehensive privacy laws — including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others as those laws take effect — have similar rights. Do Not Track and Global Privacy Control

Some browsers offer a “Do Not Track” (DNT) signal. Because there is no common industry standard for DNT, we do not currently respond to DNT signals. We do honor the Global Privacy Control (GPC) as an opt-out of “sale” or “sharing” where required by law.

If you opt in to marketing emails, you can unsubscribe at any time using the link in any email or by contacting us using the details below.

Text Messages (SMS)

If you opt in to our text message program, we use the mobile phone number you provide to send messages such as order and shipping updates, cart reminders, promotions, and other information about Racing Sport Concepts. The following describes how the program works and how we handle your information.

•     What we collect and how we use it. We collect your mobile phone number only when you provide it and affirmatively opt in (for example, by submitting it through a sign-up form or at checkout and agreeing to receive texts). We use your number solely to operate the text message program described here.

•     Consent. Your consent to receive marketing text messages is not a condition of any purchase. Message frequency varies. Message and data rates may apply.

•     Opting out and help. You can opt out at any time by replying STOP to any message. For help, reply HELP or contact us using the details below.

•     Abandoned cart messages. Our website uses cookies to help keep track of the items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages, including by text message if you have opted in.

•     Location. We do not collect precise geolocation (such as GPS) as part of the text message program. We may derive an approximate location from your IP address for analytics, security, and fraud-prevention purposes; we do not use precise location-based tracking to send text messages.

No sharing of text message data. The data-sharing practices described in this Privacy Policy exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties.

Children’s Privacy

The Service is intended for adults and is not directed to children. We do not knowingly collect personal information from children under 13 in violation of the Children’s Online Privacy Protection Act (COPPA), and our products are not marketed to anyone under 18. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.

Links to Other Sites

The Service may contain links to sites we do not operate. We are not responsible for the content or privacy practices of those sites, and we encourage you to review their privacy policies.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page and revise the “Effective date” above. For material changes, we will provide additional notice (such as by email or a prominent notice on the Service) where required. Your continued use of the Service after an update means you accept the revised Privacy Policy.
